Terms of Service

These Terms of Service ("Terms") govern your use of Handled, a product of Noe Performance LLC("we," "us," or "our"), and the SMS numbers we operate on behalf of small business customers.

1. Acceptance of terms

By using the Handled service — including by texting a business's Handled number — you agree to these Terms. If you do not agree, do not use the service.

2. Description of the service

Handled is an AI office manager for small service businesses. On behalf of a business, it responds to inbound leads and customers over SMS, assists with scheduling and sign-ups, and helps the business keep a record of its customer conversations. Noe Performance LLC operates the underlying messaging numbers and platform.

3. SMS terms

The following terms apply to text messaging through Handled:

• Opt-in.Opt-in is by consumer-initiated inbound text message. You receive messages because you texted a business's Handled number; replies are automated and relate to your inquiry.
• Opt-out. Reply STOP to opt out at any time. Reply HELP for help at any time.
• Rates.Msg & data rates may apply. Message frequency varies, and message and data charges from your mobile carrier are your responsibility.

4. Acceptable use

You agree not to use the service for any unlawful purpose, to harass others, or to interfere with the operation of the platform. We may suspend access where use violates these Terms or applicable law.

5. Limitation of liability

The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Noe Performance LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the service. Our total liability for any claim relating to the service will not exceed one hundred U.S. dollars (US $100). Messages may be delayed or undelivered, and carriers are not liable for such delays or failures.

6. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the service will be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

7. Changes to these terms

We may update these Terms from time to time. Continued use of the service after an update constitutes acceptance of the revised Terms. The effective date above reflects the current version.
